Nintendo facing legal issue in Brazil over ability to ban Nintendo Switch 2 consoles

Nintendo is facing criticism in Brazil over its End User License Agreement (EULA), particularly regarding the possibility of permanently banning Nintendo Switch 2 consoles. The controversy stems from the clause that allows Nintendo to disable a system if pirated software is detected, a practice now being challenged by Brazil’s consumer protection agency, Procon-SP.

In a press release issued on June 25, Procon-SP called on Nintendo to revise certain terms in its contract. According to the agency, some of the conditions outlined in the EULA are considered abusive under Brazilian law. The primary concern involves the permanent console bans imposed for piracy-related violations, which Procon argues are excessive and not compliant with local consumer rights protections. Banned consoles receive error code 2124-4508 and lose all access to online features.

Another concern raised by Procon-SP is the fact that Nintendo does not currently have legal representation in Brazil, which complicates enforcement of the country’s Consumer Defense Code. Addressing the issue, Álvaro Camilo, Director of Customer Service and Guidance at Procon-SP, spoke: “Without a legal representative in Brazil, the consumer is left without a clear path to resolve conflicts. It makes it harder to hold the company accountable and ensure that consumer rights are respected under Brazilian law.”

Nintendo has appointed a local law firm to handle the matter, but only for this specific case. The Brazilian agency has given the company a 20-day deadline to respond; otherwise, further actions may be taken.
