Nintendo wins lawsuit against EveryGameGuru, who streamed pirated Switch games and taunted the company

Nearly a year after the case first started, a verdict has been reached in Nintendo’s lawsuit against EveryGameGuru, who previously streamed pirated and emulated Switch games.

The case against EveryGameGuru (Jesse Keighin) received quite a bit of attention given how defiant he was against the company. Although his channels were shut down, that didn’t deter things at all. Keighin informed his audience about how to pirate games and wasn’t taking things seriously. Nintendo mentioned in its initial lawsuit that “he sent Nintendo a letter boasting that he has ‘a thousand burner channels’ to stream from and [he] ‘can do this all day.'”

After the lawsuit began, Keighin didn’t seem to be concerned. In a Facebook post, he wrote: “Should have done more research. You might run a corporation. I run the streets.” Keighin also apparently destroyed evidence and evaded Nintendo’s attempts to serve him personally. The court would go on to service via email and the home addresses of his mother, grandmother, and partner.

A Colorado federal court has now ordered Keighin to pay $17,500 in damages. We previously mentioned this, but Nintendo could have requested $1.5 million because the piracy involved was for ten games. An order has also been put in place enjoining Keighin from future infringement.

Nintendo did also have a demand to “destroy all circumvention devices”. However, it was rejected as “unclear” and “unreasonable” since these tools are mainly software applications that can be obtained online. Nintendo also requested the injunction to be applied to third parties working in concert with Keighin, but this was denied since the company was not specific.
