Factor 5, which closed down their San Rafael studio just a few weeks ago, is now being sued by its former employees. The employees claim that Factor 5 deceitfully transferring assets to a seperate company in order to avoid handing out payment.

James Smith, a San Francisco lawyer representing the employees, issued a statement.

“We allege in the suit that Factor 5 and its three founders fraudulently transferred assets, including source code and other intellectual property to Blue Harvest, which is now known as White Harvest. We believe and have alleged in the complaint that Factor 5 and White Harvest are essentially the same company, being run by the same people, being represented by the same sets of lawyers, with all the same management and ownership and control, performing all the same work that they were doing at Factor 5, just now with a new name and a new address.”

The worst part of this all? Apparently a new Star Wars Rogue Squadron was in development for Wii and all progress was transferred to White Harvest. Unfortunately, the fate of the title does not seem to be too promising at the moment.

Firebrand Games, the International handheld development specialists responsible for GRID and TrackMania, today announce details of their next project, the Nintendo DS videogame version of the hugely anticipated animated film Planet 51.

With a US theatrical release through Sony on Thanksgiving, Planet 51 is the tale of US astronaut Captain Charles “Chuck” Baker (Dwayne Johnson, The Scorpion King, Be Cool) who lands on Planet 51 thinking he’s the first person to step foot on it. To his surprise, it’s already inhabited by little green people who are happily living in a world reminiscent of a cheerfully innocent 1950’s American. The film also features the voices of John Cleese, Gary Oldman and Seann William Scott.

Mark Greenshields, CEO of Firebrand Games, commented “We have a track history of creating incredibly successful handheld titles and now, with the opportunity to work on a huge film tie-in like Planet 51, Firebrand is taking our core skill of producing triple-A driving titles into a wider arena.” He continued “Planet 51 is a game that has many diverse elements to it and we’re committed to turning the game into as big a success as the movie is going to be. With a strong storyline and some amazing visuals we’re sure that Planet 51 is going to be a massive hit on the DS.”

Planet 51 The Game is being released in the western markets by SEGA from November 2009.
