Aliens: Colonial Marines may not be coming to Wii U and is out on store shelves, but the game’s saga is far from over.

SEGA and Gearbox will now be forced to defend against a class action suit claiming that Aliens was falsely advertised.

Edelson LLC filed the suit on behalf of Damion Perrine in a Californian court yesterday. It says that demos highlighted at expos including PAX and E3 were not indicative of the final product.

A portion of the suit states:

“Unfortunately for their fans, [the] Defendants never told anyone – consumers, industry critics, reviewers, or reporters – that their ‘actual gameplay’ demonstration advertising campaign bore little resemblane to the retail product that would eventually be sold to a large community of unwitting purchasers.”

According to the suit, press embargoes that were extended up through the same morning of Aliens’ launch kept consumers in the dark about the differences between earlier demos and the final product. The suit was initiated for consumers who pre-ordered the game or purchased the product on its release date.

A 3DS rating of Dragon Book Fantasy I popped up on the ESRB about a week ago, which seemed to hint that the digital game would be coming to the eShop. This isn’t necessarily so, according to the game’s developer.

Muteki Corporation explained to IGN that the 3DS (and Xbox 360) was included due to an earlier way in which the ESRB handled downloadable ratings.

But while Dragon Book Fantasy I isn’t in development for the 3DS, there’s “a possibility” that the game could eventually make its way to the handheld system.

We’ve had the game rated for a number of platforms based on [an] earlier system of ESRB ratings. It used to be even downloadable games had to pay for ratings, so when we did our initial submission we just checked every box we thought we may want to release on

A release on 3DS is a possibility in the future (though not verified!) – we’ve talked about it but it’s not something actively in development.

Wii U – 8,262
PSP – 7,536
Wii – 1,660
Xbox 360 – 490

For comparison’s sake, here are the hardware numbers from last week:

3DS LL – 57,089
3DS – 18,833
Vita – 15,011
PS3 – 13,915
Wii U – 8,798

Xbox 360 – 515

The Famicom possessed an interesting color scheme. These days, we typically don’t see hardware that is covered in red, gold, and white colors.

Masayuki Uemura, a former Nintendo hardware designer, cleared up some misconceptions as to why the color scheme was chosen while speaking with Weekly Playboy:

“Originally, the inexpensive steel body we planned to use was too fragile, so we changed it to a highly durable plastic.”

Mario Bros. will be hitting the Japanese eShop as a Famicom download on May 8 for 500 yen. Screenshots of the game can be found above.
