Beijing Flyfish Technology Co. has created a Mario ripoff that goes beyond just the use of assets.

The title features multiple levels in which the mustached plumber is shown in his signature red hat and blue overalls as players jump to obtain mushrooms and coins. Wondering what the game’s name is? “Super Mario”.

Super Mario has been located on Baidu Inc.’s 91 Wireless online app store in China as well as Samsung Electronics Co.’s online China app store.

Beijing Flyfish co-founder Zhu Jinbiao seems to believe that no wrong has been done as he claims his company doesn’t need a license agreement or other permissions from Nintendo.

“There were already some similar kinds of PC-based games using flash technology. Our game is similar to those. Some parts are like the original. Some parts we’ve changed.”

“Super Mario” is one of numerous unauthorized Nintendo apps put up in app stores in China, Hong Kong, and Japan. Bloomberg has also come across a quiz and mobile wallpaper featuring Nintendo’s characters.

Nintendo spokesperson Yasuhiro Minagawa told the publication that the company’s legal team will be looking to crack down on these downloads:

“Nintendo has not approved these applications. Our legal team will investigate them from now.”

Jakks Pacific is teaming up with Nintendo for the first Nintendo-licensed Mario Kart ride-on.

Super Mario Kart Ride-On is the real life counterpart to Mario’s kart from Mario Kart 7, sound effects and all. The vehicle can be switched between on-road and off-road tires.

Jakks Pacific’s Ken Goodison said of the ride:

“For the first time ever, you can be in the driver seat of your very own Nintendo Kart. It’s an exciting little runner that we expect to sit competitively within other 6V ride-ons and with it being so relevant to the Nintendo Mario Kart, it should do very well.”

Super Mario Kart Ride-On will debut in the UK this coming fall/winter.

Nintendo has prevailed in a patent infringement case against International Trade Commission. Patent-licensing companies Technology Properties Limited LLC, Phoenix Digital Solutions LLC and Patriot Scientific Corporation brought on the case.

In the ruling, it was determined that the 3DS – as well as DSi – does not infringe the asserted patent.

Richard Medway, Nintendo of America’s vice president and deputy general counsel, said of the verdict:

“We are very pleased with the commission’s determination, which confirmed the judge’s finding that Nintendo’s products do not infringe the asserted patent. Nintendo’s track record demonstrates that we vigorously defend patent lawsuits, including cases in the ITC, when we believe we have not infringed another party’s patent. Nintendo continues to develop unique and innovative products while respecting the intellectual property rights of others.”
